The Hawaiian Legal Action Fund

The Hawaiian Legal Action Fund is a grassroots campaign by the people of Hawaii, to initiate and prosecute a lawsuit to recover the trust lands of the people of the Hawaiian Islands.
 
The lands to be reclaimed are those that were hijacked from the Hawaiian people through the illegal “overthrow” of the Hawaiian Kingdom government in 1893. These lands eventually ended up being illegally “ceded” by the hijackers to the United States who then illegally “ceded” the stolen lands to the State of Hawaii.
 
The Hawaiian Legal Action Fund is launching its campaign with a petition and pledge drive. The petition is for all those interested in pursuing the legal action; the pledge is for those who also want to participate in formulating (help in determining particulars of the lawsuit) and funding this legal action.
 
Although we are clear about the basics: the plaintiffs (lawful Hawaiian claimants), the defendant (the US and State of Hawaii) and goal (to get back our lands) of the lawsuit, the specifics of how to frame the lawsuit, the legal strategy, what court to file in, who our legal counsel will be…are currently being considered.
 
The only commitments being asked for at this point are for people to submit their names, indicating their interest and (for those who  wish to) to make a pledge of $5 (or more) toward the cause. We are expecting that this seemingly insignificant first step will develop into the significant legal leverage necessary to eventually compel the US to return our lands.
 
A lawsuit of this magnitude (a direct challenge of the world’s greatest super power) means having to hire a top-notch, hard-hitting, take-no-prisoners law firm to be on our legal team. This is where your $5 comes in. When we find the right law firm, we will be calling for the pledges to be contributed to the Hawaiian Legal Action Fund.
 
Participant consultations will be conducted in meetings throughout the islands as well as over electronic media to discuss and determine the components (plaintiffs list, law firm, strategy, timing, venue) and the actual content of the lawsuit.
 
We believe the time to take legal action is now!  

We know for a fact that the US’ claim to Hawaii is unlawful, therefore indefensible. We have the high legal and moral ground. We know for a fact that established international laws and principles favor our cause for Hawaiian independence.
 
We know that recent events, including those at the US Supreme Court, and global economic and political conditions present an excellent environment and opportunity for the real heirs (Kanaka Maoli) and beneficiaries (Hawaiian nationals) to take aggressive legal action to reclaim the Crown and Government lands of the Hawaiian Kingdom.
 
Who is involved?
This campaign is a kakou effort involving independence activists from many quarters. This a joint undertaking, not the project of any one ‘group.’ The campaign is for one purpose only: to conduct a people’s lawsuit against the United States to result in the return of the lands of the Hawaiian people, lawfully entrusted to the Hawaiian Kingdom to administer.
